Terms of Service
These Terms of Service ("Terms") govern the use of BoxSight, an online sales map and logistics dashboard for the container industry, available at app.boxsight.app (the "Service"). BoxSight is a trading name of Stijn Benjamin, registered with the Dutch Chamber of Commerce (KvK) under number 85508365, VAT ID NL004106731B83, established at Hoogstraat 19 A, 3011 PD Rotterdam, the Netherlands ("BoxSight", "we", "us"). By creating an account or using the Service you agree to these Terms on behalf of the organization you represent ("Customer", "you"). The Service is offered to businesses only, not to consumers.
1. The Service
BoxSight lets you manage and visualize customers, leads, containers, depots, factories, shipping lines, ports and vessel positions on an interactive map, import data via CSV or connected integrations, and track container status changes. The exact features available to you depend on your subscription plan as described on the pricing page.
The Service is under active development ("early access"). Features may be added, changed or removed. We will not remove core functionality from a paid plan without reasonable notice.
2. Accounts
You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under the accounts in your organization, including seats you assign to team members. Notify us immediately at hello@boxsight.app if you suspect unauthorized use.
3. Free trial
New organizations receive a 14-day free trial. No payment method is required and nothing is charged during the trial. When the trial ends without an active subscription, access to the Service is suspended; your data is retained for a reasonable period (at least 30 days) so you can subscribe and continue, after which we may delete it.
4. Subscriptions, fees and payment
- Subscriptions are billed monthly in advance through our payment provider Stripe. All prices are in euros and exclusive of VAT.
- Each plan includes a number of seats; additional seats are billed at the per-seat rate of your plan. Adding a seat takes effect immediately and is prorated; removing a seat takes effect at the next billing cycle.
- You can upgrade or downgrade your plan at any time. Upgrades take effect immediately with a prorated charge; downgrades take effect at the next billing cycle.
- We may change prices with at least 30 days notice by email. Price changes never apply retroactively; if you do not agree, you can cancel before the change takes effect.
- If a payment fails we will retry and notify you. If payment is not received within a reasonable period we may suspend access until payment is made.
5. Cancellation and termination
There is no minimum contract term. You can cancel your subscription at any time from the account settings; the subscription then runs until the end of the current billing period and is not renewed. We do not refund partial billing periods.
We may terminate or suspend your access with immediate effect if you materially breach these Terms (including non-payment or violation of Section 7) and, where the breach can be remedied, you fail to remedy it within 14 days of notice.
After termination you can request an export of your data for 30 days, after which we delete it in line with our Privacy Policy and Data Processing Agreement.
6. Your data
You retain all rights to the data you upload or generate in the Service ("Customer Data"). You grant us a limited license to host, process and display Customer Data solely to provide the Service. We process personal data contained in Customer Data as a processor under the Data Processing Agreement, which forms part of these Terms.
Customer Data is stored per organization and is not shared between BoxSight customers. You are responsible for having the right to upload the data you import, including contact details of third parties.
7. Acceptable use
You may not: (a) use the Service in violation of applicable law; (b) attempt to gain unauthorized access to the Service or other customers' data; (c) resell or sublicense the Service without our written consent; (d) use the Service to send unsolicited communications; (e) reverse engineer the Service except where permitted by mandatory law; or (f) place a load on the Service that is disproportionate to normal use (for example automated scraping of the API beyond your own data).
8. Third-party data sources
Parts of the Service rely on external data sources, including AIS vessel position feeds, carrier APIs (such as Maersk), geocoding services and CRM integrations you connect. This data is provided "as is": we do not control its accuracy, completeness or availability, and it may be delayed or interrupted. The Service is a commercial planning tool; do not use it for navigation, safety-of-life or other purposes that require certified real-time data.
When you connect a third-party integration (such as ActiveCampaign or HubSpot), your use of that service remains governed by its own terms, and you authorize us to exchange data with it on your behalf.
9. Intellectual property
The Service, including its software, design and branding, is and remains our property or that of our licensors. These Terms do not transfer any intellectual property rights to you other than the right to use the Service during your subscription.
10. Availability and support
We aim for high availability but do not guarantee uninterrupted access and offer no service level agreement on current plans. We may perform maintenance, where possible announced in advance. Support is provided by email at hello@boxsight.app on a best-effort basis.
11. Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages, including lost profits, lost data (beyond our backup obligations) or business interruption. Nothing in these Terms limits liability for intent or gross negligence, or any other liability that cannot be limited under Dutch law.
12. Indemnification
You will indemnify us against third-party claims arising from Customer Data or your use of the Service in violation of these Terms, including claims that you lacked the right to process the personal data you uploaded.
13. Changes to these Terms
We may update these Terms. For material changes we will notify you by email or in the Service at least 30 days in advance. If you do not agree with a change, you can cancel before it takes effect; continued use after the effective date constitutes acceptance.
14. Governing law and disputes
These Terms are governed by Dutch law. Disputes will be submitted exclusively to the competent court in the district where Stijn Benjamin is established, unless mandatory law provides otherwise.
